§ 1 Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge zwischen
Nilandra Gandhi, Einzelunternehmerin – Nilandra Personal Training,
und den Kundinnen (nachfolgend „Teilnehmerinnen“) im Bereich Coaching, Training und Gesundheitsberatung,
die über die Plattform https://fullcircleflow.systeme.io, per E-Mail oder persönlich abgeschlossen werden.

§ 2 Vertragsgegenstand

Die Trainerin bietet ganzheitliche Gesundheits- und Fitnessdienstleistungen an, online und vor Ort.
Dazu zählen insbesondere:

• Live-Gruppenkurse (z. B. Pilates-, Barre- und Mobility-Kurse)
• Einzelcoaching und physiotherapeutische Beratung
• Online-Programme und Workshops
  
  

§ 3 Vertragsabschluss

(1) Die Buchung erfolgt über das Online-Formular oder schriftlich per E-Mail.
(2) Mit Abschluss der Buchung und der Bestätigung durch die Trainerin kommt ein verbindlicher Vertrag zustande.
(3) Die Teilnahme ist personengebunden und nicht übertragbar.

§ 4 Preise und Zahlungsbedingungen

(1) Es gelten die zum Zeitpunkt der Buchung angegebenen Preise.
(2) Die Bezahlung erfolgt über Systeme.io (Stripe/PayPal) oder per Überweisung, sofern individuell vereinbart.
(3) Bei Paket- oder Mehrfachbuchungen verpflichtet sich die Teilnehmerin, die gesamte Summe zu bezahlen.

§ 5 Leistungsumfang und Ablauf

(1) Die Inhalte und Termine der Kurse werden im Buchungsprozess bekanntgegeben.
(2) Die Trainerin ist berechtigt, aus wichtigem Grund Termine zu verschieben (z. B. Krankheit).
(3) Online-Kurse finden über Zoom oder vergleichbare Plattformen statt.
(4) 10er-Karten sind ab dem Buchungsdatum drei Monate gültig.
(5) Einzelteilnahmen gelten ausschließlich für den gebuchten Termin.

§ 6 Gesundheitshinweis und Haftung

(1) Mit der Anmeldung erklärt die Teilnehmerin, dass sie sportgesund ist und sich über ihren Gesundheitszustand informiert hat.
(2) Die Teilnahme erfolgt auf eigene Verantwortung und eigenes Risiko.
(3) Bei Schmerzen, Schwindel, Unwohlsein oder anderen gesundheitlichen Beschwerden ist die Trainerin unverzüglich zu informieren.
(4) Die Trainerin übernimmt keine Haftung für gesundheitliche Schäden, die auf falsche Selbsteinschätzung oder Nichtbeachtung der Anweisungen zurückzuführen sind.
(5) Eine Haftung für mittelbare Schäden oder Folgeschäden wird ausgeschlossen, soweit gesetzlich zulässig.

§ 7 Widerruf und Rücktritt

(1) Verbraucherinnen haben das Recht, innerhalb von 14 Tagen nach Vertragsabschluss ohne Angabe von Gründen vom Vertrag zurückzutreten.
(2) Das Widerrufsrecht erlischt, wenn die Trainerin mit Zustimmung der Teilnehmerin vor Ablauf der Widerrufsfrist mit der Dienstleistung beginnt.
(3) Bei kurzfristiger Absage (unter 24 Stunden vor Beginn) verfällt die Einheit ersatzlos.
(4) Bei Ausfall eines Kurses durch die Trainerin wird ein Ersatztermin angeboten.

§ 8 Nutzungsrechte

(1) Die Weitergabe von Zugangsdaten, Kurslinks oder Inhalten an Dritte ist untersagt.
(2) Sämtliche Kursunterlagen und Aufzeichnungen sind urheberrechtlich geschützt.

§ 9 Schlussbestimmungen

(1) Es gilt deutsches Recht.
(2) Gerichtsstand ist der Sitz der Trainerin.
(3) Sollten einzelne Bestimmungen unwirksam sein, bleibt die Gültigkeit der übrigen Regelungen unberührt.

§ 10 Gerichtsstand und anwendbares Recht
Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts.
Für Verbraucherinnen gilt diese Rechtswahl nur, soweit ihnen dadurch nicht der Schutz entzogen wird, der ihnen durch zwingende Bestimmungen des Rechts des Staates ihres gewöhnlichen Aufenthalts gewährt wird.

Sofern es sich bei der Kundin nicht um eine Verbraucherin, sondern um eine Unternehmerin im Sinne des § 14 BGB handelt, ist der Gerichtsstand der Sitz der Anbieterin.
Der Gerichtsstand ist damit Rottweil, Deutschland.

 

 

Widerrufsbelehrung

Widerrufsrecht:
Sie haben das Recht, binnen 14 Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen.
Die Widerrufsfrist beträgt 14 Tage ab dem Tag des Vertragsabschlusses.

mittels einer eindeutigen Erklärung (z. B. per E-Mail) über Ihren Entschluss, den Vertrag zu widerrufen, informieren.

Folgen des Widerrufs:
Wenn Sie diesen Vertrag widerrufen, werden alle Zahlungen, die Sie geleistet haben, unverzüglich und spätestens binnen 14 Tagen zurückerstattet.

Erlöschen des Widerrufsrechts:
Das Widerrufsrecht erlischt, wenn die Trainerin mit der Ausführung der Dienstleistung mit Ihrer ausdrücklichen Zustimmung vor Ablauf der Widerrufsfrist beginnt.

 

 

Terms and Conditions (T&C) & Cancellation Policy

§ 1 Scope

These Terms and Conditions (TC) apply to all contracts between

Nilandra Gandhi, Individual Entrepreneur – Nilandra Personal Training,

And the clients (hereinafter referred to as „participants“) in the field of coaching, training and health counselling,

Which are concluded via the platform https://fullcircleflow.systeme.io, by e-mail or in person.

§ 2 Subject matter of the contract

The trainer offers holistic health and fitness services, online and on-site.

These include in particular:

• Live group courses (e.g. Pilates, Barre and Mobility courses)
• Individual coaching and physiotherapy counselling
• Online programs and workshops
  
  

§ 3 Conclusion of contract

(1) The booking is made via the online form or in writing by e-mail.
(2) With the conclusion of the booking and the confirmation by the trainer, a binding contract is concluded.
(3) Participation is personal and non-transferrable.

§ 4 Prices and payment terms

(1) The prices indicated at the time of booking apply.
(2) Payment is made via Systeme.io (Stripe/PayPal) or by bank transfer, if agreed individually.
(3) In the case of package or multiple bookings, the participant undertakes to pay the entire amount.

§ 5 Scope of services and procedure

(1) The contents and dates of the courses will be announced in the booking process.
(2) The trainer is entitled to postpone appointments for good cause (e.g. B. sickness).
(3) Online courses take place via Zoom or comparable platforms.
(4) 10-cards are valid for three months from the booking date.
(5) Individual entries are only valid for the booked date.

§ 6 Health information and liability

(1) By registering, the participant declares that she is in good health and has informed herself about her state of health.
(2) Participation is at your own risk and risk.
(3) In case of pain, dizziness, malaise or other health complaints, the trainer must be informed immediately.
(4) The trainer assumes no liability for health damage that is due to incorrect self-judgement or non-compliance with the instructions.
(5) Liability for indirect damage or consequential damage is excluded, as far as legally permissible.

§ 7 Revocation and withdrawal

(1) Consumers have the right to withdraw from the contract within 14 days of conclusion of the contract without giving any reason.
(2) The right of withdrawal expires if the trainer starts the service with the consent of the participant before the expiry of the cancellation period.
(3) In the event of a short-term cancellation (less than 24 hours before the start), the unit will be forfeited without replacement.
(4) If a course is cancelled by the trainer, a replacement date will be offered.

§ 8 Rights of use

(1) The transfer of access data, course links or content to third parties is prohibited
(2) All course materials and recordings are protected by copyright.

§ 9 Final provisions

(1) German law applies.
(2) The place of jurisdiction is the seat of the trainer.
(3) Should individual provisions be ineffective, the validity of the remaining provisions shall remain unaffected.

 

§ 10 Place of jurisdiction and applicable law

The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only to the extent that they are not deprived of the protection granted to them by mandatory provisions of the law of the state of their habitual residence.

If the customer is not a consumer, but an entrepreneur within the meaning of § 14 BGB, the place of jurisdiction is the registered office of the provider.

The place of jurisdiction is thus Rottweil, Germany.

 

 

Cancellation policy

Right of withdrawal:
You have the right to cancel this contract within 14 days without giving any reason.
The cancellation period is 14 days from the date of conclusion of the contract.

To exercise your right of withdrawal, you must inform

by means of a clear statement (e.g. By e-mail) of your decision to cancel the contract.

Consequences of cancellation:
If you cancel this contract, all payments you have made will be refunded immediately and within 14 days at the latest.

Cancellation of the right of withdrawal:
The right of withdrawal expires if the trainer begins to perform the service with your express consent before the expiry of the cancellation period.
